How we disclose private information: we may disclose some or all of the private information we collect as described above to the following third parties: To Financial Service Providers: We may disclose some or all of your Private Information to financial service Providers, such as banks, finance companies and insurance agents. We may make such disclosures about you as a consumer, customer, or former customer. To Non-Financial Companies: We may disclose some or all of your Private Information to non-financial companies, such as retailers, warranty or service contract providers, direct marketers and publishers. We may make such disclosures about you as a consumer, customer, or former customer. Between Dealer and Affiliate(s): This paragraph applies if the box for Affiliate(s) is checked at the topic of this Notice. In general, there are two categories of Private Information. One is information about your history of dealing with us, such as identification information, account history and balances, insurance coverage and payment history (“Transaction History”). The other is information reserved from other sources, including information typically found in a credit report(Third Party Data”). We and our Affiliate(s) may share Third Party Data and Transaction History with each other. We do this to provide you with the products and services we offer. We may make such disclosures about you as a consumer, customer, or former customer. To Marketing Service Providers and Joint Marketing Partners: We may disclose some or all of your Private Information to companies that perform marketing services for us or to other financial institutions with which we have joint marketing agreements, such as to offer you a financial product. We may make such disclosures about you as a consumer, customer, or former customer.
How we secure, handle, and dispose of private information and oversight of this security: we secure your data with third party companies, in our dealership, and have a designated consumer-security oversight appointee: Data is primarily secured by the Dealer Management Software (‘DMS’), and Cloud Storage Service Provider (‘CSSP)’. The provider of the DMS or the CSSP may be altered or changed without notice, and the DMS provider is responsible for ensuring that the consumer data is encrypted in the event of a data-breach. If a data breach of any kind occurs, and is confirmed to be breached the Dealer will report the breach to the FTC or appropriate government agencies within 30 days of discovery of said breach.
The Dealer also secures customer files inside of our dealership by using locked primary entry, locked individual office entry, and locking filing cabinets. The primary appointee for the Dealer for consumer-data security is the Dealer Principal. The method of disposal for our DMS is to delete records from our DMS, the method for the CSSP is to permanently delete any files from the CSSP system, the method for paper records is via paper shredder and disposed of via waste management services. Any salesperson (or similar), finance manager (or similar), dealer principal (or similar), or financial executive of the Dealer is permitted to coordinate, handle, process, and disclose your data during the course of business for the Dealer.
lf you do not want us to share Third Party Data with each other, please note this section. Note that regardless of your request, we and our Affiliate(s) are permitted by law to share Transaction History with each other. Note that this may prohibit your ability to purchase certain products, accessories, or similar items in relation to the prospective vehicle you are purchasing or your transaction with the Dealer, including but not limited to: vehicle service contracts, maintenance packages, GAP insurance, or appearance protection packages. In addition, your request to not share Third Party Data with our Affiliate(s) does not prohibit us from contacting you about additional products or services. We respect your right to make choices about the ways we collect, use and disclose your personal information. In most cases, we will ask you to indicate your choices at the time we collect your personal information. Upon your request, we will remove your personal information from our records related to the Site. Removing your personal information from our records related to this Site may prevent you from accessing and using the Site. If you wish to update or correct personal information you have already provided to us, or if you wish to remove your personal information from our records, please send your request to us via email to the address provided below. You may choose to opt out of receiving marketing emails from us at any time by sending your request to us via email to the address provided below, or by using the means provided in our marketing emails to unsubscribe. As set forth in this Policy, we may share your personal information with service providers or non-affiliated third parties so that they may offer, market, and advertise products and services directly to you. Because of the changing state of technology and indecision within the industry regarding the meaning of Do Not Track (“DNT”) signals, we currently do not make any guarantee that we will honor DNT signals.
While the Dealer shall make every effort to protect consumer and customer data, the Dealer shall not bear responsibility for any unauthorized accesses by employees or outside sources, sharing, reporting, usage, or similar of consumer data. Data breaches may occur to either the Dealer or its affiliates which may result in your data being lost, disposed of, affected, viewed, or shared. Data may be obtained by unauthorized third party sources if a breach occurs. By proceeding with purchases or use of this website, the consumer waives all liability of the Dealer and agrees to waive their right to compensation in the event of a breach.
